Courts in various jurisdictions have grappled with the challenges posed by the revolutionary technology and provided important guidance. The decision in Guerin v O'Doherty In March 2026, the Irish Court of Appeal provided its first guidance to lawyers and litigants on the use of generative AI in litigation in Guerin v O'Doherty [2026] IECA 48. The decision concerned an appeal by the defendant, Gemma O'Doherty against the dismissal of her application to strike out a defamation claim. The Court dismissed Ms O'Doherty's appeal. In rejecting all eight grounds of appeal, the Court observed that much of Ms O'Doherty's submissions and complaints addressed matters that either did not arise on the appeal, or were irrelevant to the question whether the court below had erred in refusing to strike out the proceedings (at paragraph 27). Acting in person, Ms O'Doherty used AI to prepare her written submissions for the appeal. However, she did not notify the plaintiff's solicitors in advance that she had done so. The Court found that Ms O'Doherty's submissions contained a number of "hallucinated authorities" which did not exist, or which did not support the propositions they purported to establish. This caused the plaintiff's solicitors to spend time and costs attempting to locate non-existent authorities. The Court emphasised that all parties, whether represented or not, have an obligation not to mislead the court. This includes the obligation not to rely on or advance submissions based on authorities that have no basis in law. The Court also noted that lawyers are subject to professional and ethical obligations which do not apply to litigants in person, but did not address those obligations as they did not arise in the case. The Court's guidance on AI use To assist parties, the Irish Court of Appeal set out the following general guidance for parties, whether acting through counsel or in person: 1. Parties are entitled to use AI to assist in carrying out research in respect of their case provided they do so responsibly and do not, even inadvertently, mislead the court by advancing propositions or relying upon supposed authorities which have no foundation. 2. In all cases where they do so, they should expressly inform both the other parties and the court of their use of AI. 3. A self-represented party is as equally responsible for the ultimate written or oral work as lawyers. 4. It is important, therefore, that any party who uses AI as part of their research independently verifies the accuracy of their submissions and the authorities cited as supposedly establishing the propositions advanced. 5. No authority should be cited by a party who has not verified that it is a genuine judgment of the court and that it is, or at least arguably is, authority for the proposition contended for. Consequences of improper AI use The Court had strong words of caution against the improper use of AI, noting that it could lead to wasted time and costs, cast an unfair burden on the opposing party, potentially bring the administration of justice into disrepute, and mislead the court. The Court emphasised that it had a variety of sanctions at its disposal in cases where parties use AI in breach of these guidelines and where such improper use has the potential to mislead the court. Fortunately for Ms O'Doherty, the Court declined to draw any adverse conclusions against her on that occasion, reasoning that at the time submissions were filed, no guidance was available to litigants in relation to their obligations to the other parties and to the court as regards the use of AI-generated material in proceedings. What it does mean is that going forward, all litigants and lawyers appearing before the Irish courts will have to ensure that they abide by the guidance set out
Let’s revisit so-called investigative journalist Gemma O’Doherty’s award-winning documentary on missing child Mary Boyle released on July 4, 2016. The YouTube documentary focuses on the disappearance in 1977 of the then six-year-old girl in Co. Donegal. The little girl followed her uncle across the fields from her grandparents’ home before turning back, never to be seen again. Mary Boyle remains Ireland’s longest-running missing child case. No body was ever found. No crime scene to analyse. As the credits roll at the end of the documentary, O’Doherty gives thanks to former Epstein lawyer Paul Tweed who also helped her win a High Court defamation case in January 2015 including an undisclosed sum for damages against her former employers Independent News and Media. She even got an apology. Tweed - known for representing a slew of in da club celebrities including Liam Neeson, Jennifer Lopez, Justin Timberlake, Kelsey Grammer, Nicolas Cage, Harrison Ford, Ashton Kutcher and Johnny Depp - was also there by Gemma O’Doherty’s side in December 2014 for an unfair dismissal case at the Employment Appeals Tribunal which she won. Incredibly. The context to that case has been previously covered on this Substack . Paul Tweed is in the headlines for his correspondence with Jeffrey Epstein following the financier’s 2008 conviction by a Florida state court for soliciting a prostitute and procuring a child for prostitution. Choosing to defend Epstein’s reputation in the media was a bad move for Tweed. It undermines his own reputation. Especially now that the Internet is poring over his emails to Epstein, released in a massive file dump that has rocked the world. Things will never be the same again. Babylon is burning. Heads are rolling even in the absence of arrests and proper mainstream coverage of the seriousness of the crime network uncovered. The story is too big to bury. The mainstream media has lost control of the narrative as people take matters into their town hands and research for themselves. It’s a horror show. Epstein will go down in history as one of the most prolific pedophiles to walk this earth, a Jimmy Savile type predator who got away with murder on an industrial scale. Darker still, Epstein was a symptom of an evil system that continues to work in the shadows to this day waiting for us to move on to the next distraction. Paul Tweed claims he never met Epstein in person or visited his private island but choosing to represent a man with such a criminal record does not reflect well on the Belfast solicitor, regardless. He categorically rejects the suggestion that he acted in any way inappropriately, according to The Belfast Telegraph. As for his business relationship with anti-corruption journalist Gemma O’Doherty. Tweed represented her again in August 2016, for another defamation case against Independent News and Media for an article (below) by Maeve Sheehan which questioned the production of her Mary Boyle documentary. The outcome of this case is unclear but the offending article remains online. Report reads: A second garda who contributed to a documentary about the disappearance of Mary Boyle has denied claims of political interference in the investigation of the case. Retired detective sergeant Aidan Murray, who featured in Mary Boyle: The Untold Story, has claimed the programme was “selective” and “misleading” in how it presented his interview.<

During the highly engaging four hours and 23 minute discussion with James English entitled 9/11 Was An Inside Job , former marine Ken O’Keefe revealed he also has a swastika tattooed on his body. It’s a sign of spirituality. We’ve got it all wrong. Poor ole misunderstood Hitler was the good guy. It’s not his fault everyone ended up dead, displaced, tortured or shattered, we’re told with unshakeable confidence. If only Tiny Moustache Man had been left get on with the job he started in 1930s Germany without being so rudely interrupted - we’d all be living in a Nazi utopia. There’s not a chance YouTuber James English was willing to sacrifice his 641K subscribers (and all the glory and benefits that comes with that popularity) to take a chance on an interview like that, which covers most conspiracy theories banned from discussion on YouTube, until now. It was clearly pre-arranged and given the nod from the top. A way to manage the critical thinkers. Give them plenty of perceived truth (that’s already out there anyway) throw in some misdirection (National Socialism is the only way) and big up Hitler and the Nazi party (poor guy was just doing his best). Understand this. James English is only allowed to grow an audience that large by playing by the regime’s rules and regulations. That’s how it works. Confusing as it can be at times, especially when there’s so much you agree with in between the hand signals. I’ll still watch, but with critical analysis. Prime example: I’m banned from posting on YouTube despite being extremely careful about providing rock solid evidence to all my reports. I am not allowed to grow an audience on YouTube (or Instagram or TikTok) yet this video, which reveals so much of what has been censored for so long, remains on the video sharing platform for all to see. Here’s the thing: No competent newspaper editor would randomly slap 42 faces of dead people on their front page without first double checking the backstories to make sure they relate to the headline. This in and of itself is most peculiar. A red flag. If in doubt, leave it out, remains the editor’s most trusty motto. So what on earth was The Irish Light editor Gemma O’Doherty thinking compiling a cover story laden with 42 possible court cases? It doesn’t make any sense from a journalistic perspective. “As you can see we are paying testimony to the many many young people who have died suddenly in this country since the roll out of the Covid injection,” O’Doherty announces from the back of a well stocked van in May 2023 despite later claiming (again captured by herself on video) she did not connect the jabs to the Sudden Death headline. This promo for the freesheet has the appearance of valiant journalism, exposing the very real story of excess deaths since the rollout of the trial Covid-19 injections. Except instead of highlighting the issue, the deliberate sloppiness of the cover story only undermines all the hard work of those trying to expose the upward trend of sudden and unexpected deaths since 2021 with hard facts and waterproof evidence. There’s a basic expectation in print journalism that the images match the headline, like the Mail article on AstraZeneca (below). Imagine if the Mail randomly selected obituary images for its story without double checking if they relate to the headline. It wouldn’t wash. Nor should it for The Irish Light. Forty-two unchecked stories is a big (unnecessary) gamble for the front page of a supposed Resistance newspaper. Talk about upping the odds that at least one or two would not be related to the Covid-19 injections as indeed turned out to be the case. According to the Irish Independent: One of the young men whose image is used died in a drowning accident, another is of a young woman who died of head injuries during a camogie game in a freak accident. Others whose photos are used died from a range of medical conditions, such as Sudden Adult Death Syndrome (SADS) as well as meningitis. Others, including Diego (Gilsenan), tragically took their own lives. See the way SADS and meningitis, potential consequences of the Covid-19 medical trial, are mixed in with a drowning and a head injury to dilute concern over the liability-free injections and their long list of side-effects. Unsurprisingly the mother of 18-year-old Diego Gilsenan (who died by suicide in August 2021) took umbrage at the use of her son’s image on the cover of The Irish Light, without permission or even a phone call to check if his story related to the injections. Wouldn’t you? Edel Campbell from Kingscourt, Co Cavan made contact with O’Doherty and asked that the image of her child be removed from circulation. Remember, all of this drama, was perfectly avoidable if basic journalistic protocols had been followed like checking facts (twice) or choosing images that relate to the Covid-19 injections. It’s highly suspicious that they were ignored and this reckless approach of randomly picking 42 faces was pursued for the cover story. Instead of apologising for the error, O’Doherty doubled down on her assault, as is her pattern of behaviour when confronted with wrongdoing, and proceeded to slander the good name and character of Edel Campbell persistently during her nightly livestreams under the guise of ‘investigative journalism’. She accused the grief-stricken mother of being a bad parent, of being mentally unwell. She claimed that her dead son had been a drug dealer, that he had been murdered, that her solicitors were MI5 style agents. As someone who has been falsely accused of being a
